Mediators are attorneys selected to assist in achieving a legal resolution, typically in the form of a settlement agreement. Mediators do not represent a particular party; instead, they are mutually chosen by both the plaintiff and the defendant to provide a timely solution to the case at hand. In fulfilling their duties as mediators, attorneys serve as an intermediary, making recommendations for settlements to pending litigation. Cal Mayo and Pope Mallette each have extensive experience in mediation, both on behalf the firm’s clients and in independent mediations as neutrals.
Similar to mediation, arbitration is a process by which parties work in private to resolve their dispute. However, in the arbitration process, the parties agree in advance that one or more attorneys can decide their dispute, usually after a short evidentiary hearing and arguments. The arbitrator or arbitrators have more-or-less the final authority to render a decision outside of the judicial system that will bind the parties after the decision is made. Mayo Mallette has experience both in arbitrating disputes and in guiding their clients through the arbitration process. Both Cal Mayo and Pope Mallette have been chosen as arbitrators, addressing the often-complex issues that arise in contract, construction, employment, regulatory, or other disputes.
